Hooters hosts a weekly Bike Night attended by motorcycle enthusiasts. While on his way to this event, the plaintiff collided head-on with another motorcycle on the public access road.

The plaintiff in this case collided head-on with another motorcycle on the public access road. 

He alleged that Hooters encouraged reckless behavior and had a duty to provide security in the area—seeking at least $50,000 in actual damages (medical bills), as well as punitive damages.
 
For Hooters, Haynsworth Sinkler Boyd trial attorney Frankie Marion moved for judgment on the pleadings. We argued that the accident occurred off Hooters’ property on a public road, and that Hooters had no duty to police public property. 

The court ruled in Hooters’ favor.
