How Does a Hospital Collect What it is Owed

Haynsworth Sinkler Boyd was retained by a hospital to file a debt collection action.  At a hearing on the hospital’s motion for summary judgment, the defendant argued constitutional grounds as a defense to the action.  The judge asked for briefing on this constitutional issue.  After reading our brief, the judge agreed with our position and granted summary judgment against the defendant.  When an unusual constitutional law issue arose in a “typical” debt collection lawsuit, HSB’s healthcare team was ready for the challenge.
