Successful Defense of a Hospital

Trial team uses computer technology to demonstrate Plaintiff's alteration of photos

The cause of action was a premises-liability claim.

Plaintiff, a visitor to the hospital, slipped and fell in the hospital’s food court. Plaintiff claimed she suffered permanent brain injury as well as other significant and permanent injuries including pain in her neck, shoulder and back.  She also claimed she was totally and permanently disabled and unable to return to work.

A key piece of evidence in the case was photos Plaintiff produced purporting to show her physical condition before and after the incident.  Using sophisticated computer animations, the Haynsworth Sinkler Boyd Trial Team was able to demonstrate to the jury that Plaintiff had altered dates on the back of the photos.  This proved devastating to Plaintiff's case and, after 2.5 days of trial, the jury returned a verdict in favor of the Hospital.
