We understand and negotiate renewable energy project finance transactions, draft and review sustainable development contacts, advise and counsel on green building issues, and provide policy monitoring and advocacy at both the state and national level, we are committed to serving as your trusted advisers and advocates in overcoming challenges and in maximizing success.

Over the last fourteen years, the leader of our Washington office has monitored Congressional and administrative policies and provided advocacy services and strategic advise to numerous Fortune 500 energy clients on a variety of  issues including air emissions standards, climate change, and renewable energy policy including tax incentives.  
 

MATTERS INCLUDE

  • Negotiating and structuring the terms of  landfill-methane gas-to-electricity project contracts at a closed county landfill including gas purchase agreements, power purchase contracts, the sale of carbon credits and renewable energy certificates, and both state and federal tax and other economic development credits.
  • Serving as corporate counsel in a transaction involving a biomass cogeneration facility with the sale of electricity and renewable energy certificates to a third party electric utility company subject to a mandatory renewable portfolio standard.
  • Representing a coalition of nine  major wind energy producers in the United States in their successful effort in the recent stimulus legislation to reform/modify the existing wind energy tax credit thereby providing more effective incentives to stimulate the growth and viability of this important, emerging industry.
  • Drafting and reviewing contracts for LEED certification and compliance.
  • Assisting in drafting a city ordinance that providing incentives for third-party certified, energy efficient commercial and residential buildings.
  • Representing the world's largest manufacturer of power generation equipment, and the largest supplier of wind turbines in the United States on a Federal tax advocacy matter concerning renewable energy incentives.
  • Representing a clean coal technology company which achieved the inclusion of their “refined coal” process as a source of  renewable energy eligible for tax credits in the Energy Policy Act of 2005.
  • Providing Federal advocacy services on a variety of issues, including environmental, to the largest natural gas pipeline company in North America.
  • Representing a coalition of major national hydroelectric energy producers (including investor-owned utilities, public power, and cooperatives) in the enactment of federal laws to reform the hydroelectric relicensing process.
  • Assisting boards of nonprofit corporations in drafting green policies relating to procurement of goods and services.
