Andrea Brisbin advises and represents a broad spectrum of national, regional and local healthcare providers involving the labyrinth of regulatory and operational issues they face on a daily basis.  She advises institutions and practitioners alike regarding such issues as facility and professional licensing, Certificate of Need, certification, reimbursement, fraud and abuse, controlled substances regulation, scope of practice, and patient privacy.  She also assists providers with operational issues such as employment contracts, policies and disputes, general contracts, corporate management, medical staff peer review and fair hearings.  Ms. Brisbin particularly enjoys providing advice and counsel that adds value to clients’ strategic planning and decision-making processes. 

Ms. Brisbin began her career in government, working first as a civilian government contracts and employment litigator for the United States Department of the Navy and then as a Maryland Assistant Attorney General counseling health professional licensing boards. She also has represented public higher educational institutions in negotiating employment contracts and in employment discrimination litigation.  Her experience in both the public and private sectors enables her to identify and work towards solutions that achieve clients’ goals as well as those of the government entities that regulate them.


  • Assisted numerous healthcare providers with state regulatory issues (licensing, Certificate of Need, certification) involving the establishment or acquisition of new and replacement healthcare facilities and services, including:
    • Construction of new and replacement hospitals, nursing homes, continuing care retirement communities, and ambulatory surgery centers
    • Acquisition of assisted living and continuing care retirement communities
    • Expansions of acute care hospitals, psychiatric and substance abuse facilities, and ambulatory surgery centers
    • Establishment of new home health agencies, including obtaining the first CON in South Carolina to operate a pediatric home health agency.
  • Represented psychiatric facilities, school-based and private rehabilitative therapy providers, and physician practices in appeals challenging Medicaid audit findings
  • Counseled clients regarding various employment matters, including company policies, employee terminations and discrimination claims, and employer obligations under the Patient Protection and Affordable Care Act (PPACA)
  • Represented multi-state physician practice in federal court and arbitration proceedings against former billing contractor
  • Represented practitioners and institutions in administrative litigation before state agencies and the S.C. Administrative Law Court
  • Assisted hospital with negotiating settlement of dispute over D&O policy coverage of class action litigation involving allegations of unfair pricing for uninsured patients
  • Represented state higher education institution before local, state and federal agencies and courts regarding employment discrimination and other regulatory issues

During her private practice career in South Carolina, Ms. Brisbin has served as Section Chair and a Council member of the Health Care Law Section of the South Carolina Bar.   Prior to joining Haynsworth Sinkler Boyd, Ms. Brisbin practiced with the government and public policy group of a regional law firm.
